I'm not sure if Mindflayer as a name is still used. But the Beholder had a specific design that could be copyrighted while the Mindflayer could be argued to be ripping off the Cthulhu Mythos.

Yes they are. This was one of the reasons they replaced the Beholder with the Evil Eye.
I'm surprised they're still getting away with having Mindflayers in the games.
